Crime victims are entitled to the
following certain basic  rights:

  • To be treated with dignity and
    compassion by the criminal justice
    system.
  • To be informed about the criminal
    justice process.
  • To be free from intimidation.
  • To have inconveniences
    associated with participation in the
    criminal justice process minimized
    to the fullest extent possible.
  • To make at least one telephone call
    from the police station, provided
    the call is reasonable in both
    length and location called.
  • To medical assistance if, in the
    judgment of the law enforcement
    agency, medical assistance
    appears necessary.
  • To be notified if presence in court
    is not needed.
  • To be informed about available
    remedies, financial assistance and
    social services.
  • To be compensated for their loss
    whenever possible.
  • To be provided a secure, but not
    necessarily separate, waiting area
    during court proceedings.
  • To be advised of case progress
    and final disposition.
  • To the prompt return of property
    when no longer needed as
    evidence.
  • To submit a written statement
    about the impact of the crime to a
    representative of the county
    prosecutor's office which shall be
    considered prior to the
    prosecutor's final decision
    concerning whether formal criminal
    charges will be filed; and
  • To make, prior to sentencing, an in-
    person statement directly to the
    sentencing court concerning the
    impact of the crime. This statement
    is to be made in addition to the
    statement permitted for inclusion in
    the persistence report.

The legal advocacy services at SAFE in Hunterdon are comprised of four
components: the director of legal services, the legal advocate, the municipal
court advocate, and the crisis intervention team (CIT).

Director of Legal Services
SAFE in Hunterdon's Director of Legal Services is a pro bono attorney who
provides legal information and representation for domestic violence matters.  He
is available to answer questions and lend support to all victims of domestic
violence and sexual assault who contact SAFE in Hunterdon for legal
information on these specific matters.

In addition, the attorney is available to provide free legal representation to
victims of domestic violence who qualify for free legal representation through
Hunterdon County Legal Services.  For more information on how you may
qualify, please see below.*

Legal Advocate
The legal advocate provides court accompaniment, support and information
about the court process at the Superior Court of Hunterdon County for
individuals who have applied for and received a temporary restraining order.
The legal advocate also provides accompaniment and assistance to victims of
domestic violence and sexual assault should they decide to file a police report
or apply for a temporary restraining order. In addition, the legal advocate
supports crime victims at criminal contempt hearings for restraining order
violations.

Municipal Court Advocate
The Muncipal Court Advocate provides court accompaniment, information,
referrals and support to victims of domestic violence before, during and after
the criminal trials and court appearances of their abusers. The Advocate also
serves as a liaison between the victim and Municipal Court personnel, which
includes judges, prosecutors and court administrators.

Crisis Intervention Team (CIT)
The crisis intervention team responds to domestic violence and sexual assault
calls throughout Hunterdon County. This advocacy comes at the time of the
crisis by responding to local police departments and to the Hunterdon Medical
Center. The team is comprised of trained volunteers who provide 24-hour
support, advocacy and information for victims of domestic violence and sexual
assault.

you qualify for free legal representation. When you contact HCLS, they will
conduct an initial financial screening interview to see if your income and assets
qualify you for a free attorney.
